New Time Keeping System and Problems at 24 Hour Facilities

The KOSE office has been made aware that there are issues related to the new time keeping system, in particular at our 24 hour facilities.

You need to know that you must be paid for all hours worked. If any problems arise first contact your manager to fix the problem. If they do not fix it, contact HR and let them know. If they do not fix your issue or tell you that you were not clocked in correctly and they therefore are not going to pay you, contact a KOSE steward or the KOSE office. They must pay you for all hours worked, that is federal law. You may also contact the following;

Re: Collective bargaining

 

&nbsp This is an urgent request for your assistance on an issue of grave importance to teachers in Kansas.

  The Kansas School Superintendents Association (KSSA) has formally asked the Kansas Legislature to make radical and dramatic changes to the collective bargaining law in Kansas. Under the KSSA proposal, collective bargaining would be limited to nothing more than salary, sick leave, personal leave, and pay for supplemental duties. There are 23 additional topics that the KSSA proposal would strike from the list of negotiable items. Under this plan, the school board may refuse to negotiate pay for extended duties, the grievance procedure, and even voluntary payroll deductions. The KSSA is asking the legislature to prohibit negotiations on wearing apparel, holidays, insurance benefits, and even hours of work.

  We must determine if this proposal is the demand of a small group of anti-collective bargaining superintendents or if it is supported by all of them. KNEA’s leadership does not believe that the majority of Kansas superintendents wish to return teaching in Kansas to the days when the administration was more concerned with the length of a teacher’s skirt than the teacher’s skills in the classroom.

  We need you, as a community member, to put the question to your superintendent. Essentially, we want you to put your superintendent on record on this proposal. Your local Superintendent needs to hear from you as a community member. Ask them simply if they support collective bargaining or not.

  If you need contact information for your local superintendent you may contact me via email and I will send you that information ASAP. Please also email any response that you receive from your local Superintendent regarding their position on collective bargaining at terry.forsyth@knea.org

 

It is critically important that we get this information as soon as possible. This proposal could come before the committee very quickly.
Recommit to your Union

This legislative session we have seen the the legislature attempt to silence your voice.

 

HB 2023 which has passed the house and is expected to pass the senate and be signed by the Governor takes away your right to have your PEOPLE/COPE donations deducted from your paychecks. It also goes much further in what we can and cannot doin the political arena.

 

We expect them to take away our right to collect dues by paycheck deduction with HB2123. They believe that you are not dedicated enough to pay your dues in another manner so your voice can continue to be heard. We know better.

 

In preparation for losing our paycheck deduction, someone from the Union office or one of our stewards will approach you about signing up to have your dues taken out of your bank account or credit card. We will also put up a notice of how you can do it online. That on line availability should happen by mid-February. We will not turn in any authorizations until we lose our ability to deduct dues from your paycheck.

 

While we hope it does not come to this, we are preparing for the worst. If you wish to have your Union continue, dues may have to be collected in this or some other fashion.

 

Please be kind when you are approached and please support your Union by signing up for an alternate means of paying your dues.

 

Keep your voice heard, recommit to your Union.

Comparison of the Bad Bills in the House

We know there has been a lot of confusion on the two major bills effecting state employees, so hopefully this will clear that up. Do not make any mistake, we oppose 2023 and 2123 because it will significantly weaken your political voice and your bargaining at the table.

 

HB 2023 – this bill strips state employees of their ability to pool their money collectively and interact on an effective manner in the political arena. Proponents of this bill have stated that it costs too much, even though KOSE pays the administrative fees. They also claim that they aren't limiting, but protecting, however they are limiting one option out of several for people to contribute to a PAC. Under current law, KOSE (nor any other union) cannot co-mingle money from dues and money for our PAC. We are audited every year for this very purpose. Currently, you can contribute to the PAC by check, bank draft or automatic payroll deduction. This bill eliminates payroll deduction for political purposes. This bill also sets stricter guidelines on what is ‘political.’ The penalty for violating this bill is a 2 year ban from collecting dues.

 

HB 2123 – This bill strips away your ability to pay union dues out your check. It loosely defines how you can ask anyone to join a union. If you violate the loosely defined statute, you will be hit with a misdemeanor. This bill will also create two classes of employees; those covered by the KOSE Master Agreement and supplemental agreements and those who will dilute your bargaining power at the table. In essence, this bill could potentially create thousands of individuals who negotiate their own terms of employment and defund unions. It is a union killer.

 

Lastly, since I find it relevant and hypocritical

 

HB 2022 – Allows employers to withhold monies from your paycheck for work expenses, items lost, broken, loans, etc for the sake of convenience.

Overtime OSH LSH

Today I had a meeting scheduled with Secretary Sullivan on the massive amounts of overtime being demanded at Larned State Hospital and Osawatomie State Hospital.

Secretary Sullivan rescheduled the meeting at the last minute. it will now be held on December 7th. I am going to take a strong stand that this is no longer and acceptable practice. This is 1900's management. If they do not present a concrete plan to immediately put an end to these practices, we will go forward with a campaign to educate the public as to what is happening at these institutions.

I would urge all of you that work in these institutions to start contacting your newly elected representatives and educating them on the issue.

The state is not only abusing the dedicated staff who work at these institutions, but is endangering the safety of the clients by demanding so many hours.

i will continue to keep you informed as to the meetings and what transpires. If they will not fix the problem, we will fight.
